Terms of Service

1. Who we are and what these terms cover

JemSpace is a private journaling service operated by Jemma Dennis Ltd, a company registered in England and Wales (company number 14929839) whose registered office is at 85 Wimpole Street, London, England W1G 9RJ. Jemma Dennis, a qualified psychotherapist, is director of the company.

JemSpace is a website at www.jemspace.co.uk which you use in a web browser.

These terms are a contract between you and us. They apply when you create a JemSpace account and use any of the following services:

• JemSpace Journal (£7.99 per month). A paid monthly subscription providing private journaling with guided prompts and access to two guided meditations, with the option to purchase the full meditation library for a single one-off payment.
• JemSpace Reflect with Jemma (£109 per month). A paid monthly subscription providing private journaling with guided prompts, the full meditation library, and a personal written reflection from Jemma in response to one entry each week.
• JemSpace Clinical. A free journaling tool for Jemma's existing therapy clients, including access to the full meditation library. Separate arrangements in your therapy agreement with Jemma also apply, and where the two differ, your therapy agreement takes priority.
• We may change what is included in each plan from time to time, and may add, rename or withdraw plans. Section 12 explains how we will tell you about changes that materially reduce what your plan includes.

You agree to these terms by ticking the box that says so and creating an account, and we record which version you accepted and when. If you do not agree, please do not create an account.

2. What JemSpace is, and importantly, what it is not

This section matters more than any other. Please read it carefully.

JemSpace Journal and JemSpace Reflect with Jemma are journaling and self-reflection services. They are not therapy, counselling, medical treatment, or a substitute for any of these.

Subscribing to JemSpace Journal or JemSpace Reflect with Jemma does not create a therapist-client relationship between you and Jemma Dennis.

The free plan for Jemma's existing therapy clients is different. It sits alongside the therapy she provides. It is still not a substitute for your sessions, and it is not a way of contacting Jemma between them unless she has told you otherwise.

Jemma's written reflections on the Reflect with Jemma plan are general prompts for self-reflection. They are not clinical advice, diagnosis, or treatment, and they are not tailored health advice.

Journal entries are not monitored in real time. Nobody is reading your entries as you write them, and on plans where Jemma does not write back to you, entries are not read at all. Her administrator account is technically able to open any entry, and the service records it whenever an entry is opened.

JemSpace is not an emergency or crisis service. If you are in crisis or concerned for your immediate safety, contact Samaritans on 116 123 (free, 24 hours), call 999, or contact NHS 111. Do not use JemSpace to seek urgent help.

If Jemma believes, in her professional judgement, that JemSpace is not an appropriate service for you, she may contact you to discuss alternatives, decline a subscription, or end your subscription with a pro-rata refund of any unused period.

3. Who can use JemSpace

You must be at least 18 years old to create an account.

You must provide accurate information at sign-up and keep your login details private. You are responsible for activity on your account.

Accounts are personal to you and may not be shared or transferred.

JemSpace is offered to users in the United Kingdom. We do not market or direct it to people in other countries, and if you choose to use it from outside the UK you do so on your own initiative.

If you join as a paying member, we ask for your date of birth when you sign up and use it to confirm that you are 18 or over. If the date you give shows that you are under 18, the account is not created. We also ask which age range you fall into, your gender identity, and whether you are currently in therapy or have been in the past. Those three questions are optional and you may skip them; your answers do not affect whether you can sign up. Our Privacy Policy explains what we do with all of this.

If you are on the free plan for existing therapy clients, Jemma already holds these details through your therapy agreement, so JemSpace does not ask you for them again.

4. Prices, payment, and renewals

JemSpace Journal costs £7.99 per month. JemSpace Reflect with Jemma costs £109 per month.

Prices are shown inclusive of VAT where VAT applies.

Payments are processed by our payment provider. We never see or store your card details.

Subscriptions renew automatically each month on your billing date until you cancel.

If a payment fails, we will retry it and notify you. If payment is not received within 7 days, your account may be suspended or downgraded until payment is made. Your journal entries are not deleted because of a failed payment.

We may change prices by giving you at least 30 days' notice by email. If you do not accept a price change, you can cancel before it takes effect. A change will not apply to a period you have already paid for.

5. Your right to cancel, including your 14-day cooling-off period

Cooling-off period. You have a legal right to cancel within 14 days of subscribing, without giving a reason, under the Consumer Contracts Regulations 2013.

Because JemSpace begins as soon as you subscribe, we ask you at sign-up to confirm that you want it to start immediately and that you understand you will lose the right to a full refund once it has. If you then cancel within the 14 days, we may deduct an amount in proportion to the service you have already received and refund the balance.

A one-off purchase of downloadable or streamed content works differently, because the law treats digital content differently from a service. If you ask us to make it available immediately and confirm that you are giving up your cancellation right, you will not be able to cancel that purchase once your access has started.

Cancelling after the cooling-off period. You can cancel at any time in your account settings, and cancelling must be no harder than subscribing was. Your subscription then runs to the end of the current billing month and does not renew. No further payments are taken.

After cancellation you can still log in to read and export your entries for 90 days, after which your entries and your account are deleted. If you would rather they went sooner, ask us and we will delete them within 30 days. Different arrangements apply to the free plan for therapy clients, because those entries form part of a therapy record, and our Privacy Policy explains them.

6. The Reflect with Jemma written responses

On the Reflect with Jemma plan, Jemma personally reads one journal entry you submit each week and replies with a short written reflection, usually two reflective questions.

Response time. We aim to respond within 48 hours of your entry being submitted. This is a target, not a guarantee. Response times may occasionally be longer, for example during holidays, illness, or periods of high demand. Where Jemma is unavailable for an extended period, we will let you know by email or by a notice on the site.

Journal entries on paid plans are limited to 1,600 words. The site shows a word counter as you write.

Jemma responds to entries as submitted. One entry receives one written reflection. Reflections are not an ongoing correspondence or a messaging service.

If an entry raises a concern that Jemma believes needs more support than JemSpace can offer, she may signpost you to appropriate services in her reflection or by email.

7. Your journal content and your privacy

Your journal entries belong to you. You keep all rights to what you write.

You give us the limited permission needed to store, display, and process your entries solely to provide the service to you, as described in our Privacy Policy.

Removing an entry. You can remove an entry from your journal at any time. Removing it takes the entry out of your journal so that you no longer see it. On the paid plans a removed entry is permanently deleted after 30 days, so you have a short window in which to change your mind. On the free plan for therapy clients it is not erased: the entry is retained, remains visible to Jemma, and is marked as removed. Jemma can put it back if you ask her to.

If you want an entry erased rather than removed, please ask Jemma. What is possible, and when, is governed by the retention period set out in our Privacy Policy.

Who can see your entries. Entries are private. Where a plan includes a written response from Jemma, and on the free plan for therapy clients, only Jemma reads them. On other plans they are not read, although her administrator account is technically able to open any entry and the service records whenever one is opened.

Important. Confidentiality has narrow limits. In exceptional circumstances, Jemma may be required by law, or permitted by her professional and ethical obligations, to share information without consent, for example where there is a serious and imminent risk of harm to you or to someone else, or where a court orders disclosure. If you are a therapy client, the confidentiality provisions of your therapy agreement also apply and explain how she handles this.

Reviews and feedback. If you leave a review or send us feedback, we may quote it on our website or on social media. We will never publish your name or anything you have written in your journal.

8. Acceptable use

Your journal is your private space and we place very few rules on what you write in it. You must not, however:

• use JemSpace to store or share content that is unlawful for you to possess;
• attempt to access anyone else's account or data, probe or test the security of the service, or interfere with its operation;
• copy, record, redistribute, or resell the guided meditations or any other JemSpace content;
• use the service on behalf of another person, or submit another person's private information as if it were your own;
• use abusive or threatening language directed at Jemma in Reflect entries. Reflections may be declined for such entries, and repeated abuse may lead to termination under section 10.

9. Meditation library and intellectual property

All guided meditations, prompts, app design, and written materials in JemSpace are owned by Jemma Dennis Ltd and protected by copyright.

Your subscription gives you a personal, non-transferable licence to stream the meditations within the app for as long as your access tier includes them. It is not a download or transferable ownership.

If you have bought content outright rather than as part of a subscription, you keep access to it for as long as you hold a JemSpace account, whether or not you continue to subscribe. Access ends when your account is deleted, because the licence is to stream within JemSpace rather than to download or keep.

10. Suspending or ending your account

We may suspend or terminate your account if you seriously or repeatedly break these terms, if required by law, or if Jemma judges that the service is not appropriate for you (section 2).

Unless termination is for serious misuse, we will give you notice and a pro-rata refund of any unused subscription period, and a reasonable opportunity to export your entries.

We may withdraw or materially change the service by giving at least 30 days' notice, in which case you may cancel and receive a pro-rata refund.

The free plan for existing therapy clients is provided alongside your therapy with Jemma. If your therapy with her comes to an end, we will offer you the option of moving to a paid plan. If we do not hear from you, we will email you to say that your account is closing, and it will close 30 days after that email.

Closing your account does not delete what you have written. Because those entries form part of a therapy record, they are kept for the period set out in our Privacy Policy. On the paid plans, entries can be deleted sooner if you ask us.

11. Service availability and our responsibility to you

We aim to keep JemSpace available at all times but cannot promise uninterrupted access. The service may occasionally be unavailable for maintenance or reasons outside our control.

What we do not limit. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law, and nothing in these terms affects your statutory rights as a consumer.

What we are not responsible for. We are not responsible for losses that are not a foreseeable result of our breaking these terms, or for losses connected to any business use of the service. JemSpace is supplied for private use only.

What we are responsible for. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking them or of our failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if at the time you subscribed both you and we knew it might.

Decisions you take. JemSpace is not therapy, medical treatment or advice, and is not a substitute for professional help. We are not responsible for any decision you take, or do not take, on the basis of anything you find in JemSpace, including a written reflection from Jemma.

The limit on our liability. Apart from the matters listed above which we do not limit, our total liability to you for all claims connected with JemSpace is limited to the greater of the amount you have paid us in the 12 months before the claim arose and £100.

12. Changes to these terms

We may update these terms from time to time. For significant changes we will give at least 30 days' notice by email and ask you to re-accept the terms when you next sign in. If you do not accept, you may cancel before the change takes effect.

The version of the terms you accepted, and when, is recorded against your account.

13. Complaints, governing law, and disputes

If something goes wrong, please contact jemma@jemmadennis.com first and we will try to put it right within 14 days.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings there.

Nothing in this section prevents you using alternative dispute resolution or complaining to a relevant regulator, including the Information Commissioner's Office for data matters.

14. General

If any part of these terms is found to be unenforceable, the rest of them continue to apply. We may transfer these terms to another business if JemSpace is sold or reorganised, and we will tell you if that happens; your rights will not be affected. Nobody other than you and us has any right to enforce these terms.
