1. Who we are and what these terms cover

JemSpace is a private journaling service operated by Jemma Dennis, a qualified psychotherapist, trading as [trading name / company name and number, to confirm], of [business address]. You can contact us at jemma@jemmadennis.com.

These terms are a contract between you and us. They apply when you create a JemSpace account and use any of the following services:

JemSpace Journal (£3.99 per month). A paid monthly subscription providing private journaling with guided prompts and access to two guided meditations, with the option to purchase the full meditation library for a single one-off payment.

JemSpace Reflect with Jemma (£39 per month). A paid monthly subscription providing private journaling with guided prompts, the full meditation library, and a personal written reflection from Jemma in response to your entries.

JemSpace Clinical. A free journaling tool for Jemma's existing therapy clients. Separate arrangements in your therapy agreement with Jemma also apply, and where the two differ, your therapy agreement takes priority.

By ticking the sign-up boxes and creating an account, you agree to these terms. If you do not agree, please do not create an account.

2. What JemSpace is, and importantly, what it is not

This section matters more than any other. Please read it carefully.

JemSpace Journal and JemSpace Reflect with Jemma are journaling and self-reflection services. They are not therapy, counselling, medical treatment, or a substitute for any of these.

Subscribing to JemSpace Journal or JemSpace Reflect with Jemma does not create a therapist-client relationship between you and Jemma Dennis.

Jemma's written reflections on the Reflect with Jemma plan are general prompts for self-reflection. They are not clinical advice, diagnosis, or treatment, and they are not tailored health advice.

Journal entries are not monitored in real time. Nobody is reading your entries as you write them, and entries on the Journal plan are not read at all.

JemSpace is not an emergency or crisis service. If you are in crisis or concerned for your immediate safety, contact Samaritans on 116 123 (free, 24 hours), call 999, or contact NHS 111. Do not use JemSpace to seek urgent help.

If Jemma believes, in her professional judgement, that JemSpace is not an appropriate service for you, she may contact you to discuss alternatives, decline a subscription, or end your subscription with a pro-rata refund of any unused period.

3. Who can use JemSpace

You must be at least 18 years old to create an account. By creating an account you confirm that you are 18 or over.

You must provide accurate information at sign-up and keep your login details private. You are responsible for activity on your account.

Accounts are personal to you and may not be shared or transferred.

For JemSpace Reflect with Jemma, we may ask you to confirm your age as part of onboarding before written reflections begin. [Solicitor to align this with the onboarding process Jemma adopts.]

4. Prices, payment, and renewals

JemSpace Journal costs £3.99 per month. JemSpace Reflect with Jemma costs £39 per month. The full meditation library is available to Journal members for a one-off payment of £9.99.

All prices include VAT where applicable. [Solicitor/accountant to confirm VAT treatment.]

Payments are processed by Checkout.com. We never see or store your card details.

Subscriptions renew automatically each month on your billing date until you cancel.

If a payment fails, we will retry it and notify you. If payment is not received within [7] days, your account may be suspended or downgraded until payment is made. Your journal entries are not deleted because of a failed payment.

We may change prices by giving you at least 30 days' notice by email. If you do not accept a price change, you can cancel before it takes effect.

5. Your right to cancel, including your 14-day cooling-off period

Cooling-off period. You have a legal right to cancel within 14 days of subscribing, without giving a reason, under the Consumer Contracts Regulations 2013.

Because JemSpace is a digital service that begins as soon as you subscribe, if you use the service during the 14 days and then cancel, we may deduct an amount proportionate to the service already provided before refunding the balance. Cancelling after the cooling-off period. You can cancel at any time in your account settings, and cancelling must be no harder than subscribing was. Your subscription then runs to the end of the current billing month and does not renew. No further payments are taken.

The £9.99 meditation library purchase is a one-off purchase of digital content. Once you have accessed the library, the 14-day cancellation right no longer applies to that purchase, and you will be asked to acknowledge this at the point of purchase. [Solicitor to confirm wording.]

After cancellation you can still log in to read and export your existing entries for [90] days, after which your account and data are deleted in line with our Privacy Policy. You can request earlier deletion at any time.

6. The Reflect with Jemma written responses

On the Reflect with Jemma plan, Jemma personally reads each journal entry you submit and replies with a short written reflection, usually two reflective questions.

Response time. We aim to respond within 48 hours of your entry being submitted. This is a target, not a guarantee. Response times may occasionally be longer, for example during holidays, illness, or periods of high demand. Where Jemma is unavailable for an extended period, we will let you know by email or by a notice in the app.

Journal entries on paid plans are limited to 1,600 words. The app shows a word counter as you write.

Jemma responds to entries as submitted. One entry receives one written reflection. Reflections are not an ongoing correspondence or a messaging service.

If an entry raises a concern that Jemma believes needs more support than JemSpace can offer, she may signpost you to appropriate services in her reflection or by email.

7. Your journal content and your privacy

Your journal entries belong to you. You keep all rights to what you write.

You give us the limited permission needed to store, display, and process your entries solely to provide the service to you, as described in our Privacy Policy.

Who can see your entries. Entries are private. On the Journal plan, no one reads your entries. On the Reflect with Jemma plan, only Jemma reads them. On the Clinical plan, only Jemma reads them.

Important. Confidentiality has narrow limits. In exceptional circumstances, Jemma may be required by law, or permitted by her professional and ethical obligations, to share information without consent, for example where there is a serious and imminent risk of harm to you or to someone else, or where a court orders disclosure. 8. Acceptable use

Your journal is your private space and we place very few rules on what you write in it. You must not, however:

use JemSpace to store or share content that is unlawful for you to possess;

attempt to access anyone else's account or data, probe or test the security of the service, or interfere with its operation;

copy, record, redistribute, or resell the guided meditations or any other JemSpace content;

use the service on behalf of another person, or submit another person's private information as if it were your own;

use abusive or threatening language directed at Jemma in Reflect entries. Reflections may be declined for such entries, and repeated abuse may lead to termination under section 10.

9. Meditation library and intellectual property

All guided meditations, prompts, app design, and written materials in JemSpace are owned by Jemma Dennis [or company name] and protected by copyright.

Your subscription gives you a personal, non-transferable licence to stream the meditations within the app for as long as your access tier includes them. The £9.99 library purchase gives Journal members the same in-app access to the full library for as long as they hold a JemSpace account; it is not a download or transferable ownership.

10. Suspending or ending your account

We may suspend or terminate your account if you seriously or repeatedly break these terms, if required by law, or if Jemma judges that the service is not appropriate for you (section 2).

Unless termination is for serious misuse, we will give you notice and a pro-rata refund of any unused subscription period, and a reasonable opportunity to export your entries.

We may withdraw or materially change the service by giving at least 30 days' notice, in which case you may cancel and receive a pro-rata refund.

11. Service availability and our responsibility to you

We aim to keep JemSpace available at all times but cannot promise uninterrupted access. The service may occasionally be unavailable for maintenance or reasons outside our control.

What we do not limit. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law, and nothing in these terms affects your statutory rights as a consumer.

What we are not responsible for. We are not responsible for losses that are not a foreseeable result of our breaking these terms, or for losses connected to any business use of the service. JemSpace is supplied for private use only.

12. Changes to these terms

We may update these terms from time to time. For significant changes we will give at least 30 days' notice by email and ask you to re-accept the terms in the app. If you do not accept, you may cancel before the change takes effect.

The version of the terms you accepted, and when, is recorded against your account.

13. Complaints, governing law, and disputes

If something goes wrong, please contact jemma@jemmadennis.com first and we will try to put it right within [14] days.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings there.

Nothing in this section prevents you using alternative dispute resolution or complaining to a relevant regulator, including the Information Commissioner's Office for data matters.
